TERMS AND CONDITIONS OF THE Qπш [KU-PI-SH] LOYALTY PROGRAM


These terms and conditions ("Terms and Conditions") define the participation conditions for the loyalty
program ("Program") organized by Art Works Sp. z o.o. with its registered office in Łomianki at ul. Kampinoska
2, entered into the National Court Register by the District Court for the capital city of Warsaw, XIV Commercial Division of the National Court Register under the number KRS 0000047711, NIP 1181611037, REGON 017313591, with share capital in the amount of PLN 61,000 paid in full ("Organizer"), in the Republic of Poland.

I. DEFINITIONS:

Within these Terms and Conditions, the following terms written with a capital letter have the meaning as
follows:
1.1. "Declaration" means an application for admission to the Program, filled in by a Participant in accordance
with the principles of the Terms and Conditions, in an electronic form or via the Online Store website
1.2. "Participant" means a natural person who has been registered in the Program on the basis of a submitted Declaration completed in accordance with the Terms and Conditions;
1.3. "Participant's Account" means the account created with personal details (name and surname, e-mail
address) of the Participant in accordance with the Terms and Conditions.
1.4. "Boutiques" mean the Organizer's stationary stores under the QПШ Robert Kupisz brand included in the Program: Mokotowska 48 in Warsaw, Galeria Mokotów in Warsaw, Klif in Gdynia and Stary Browar in Poznań.
1.5. "Online store" means the QПШ Robert Kupisz online store run by the Organizer at the Internet address www.robertkupisz.com.
1.6. "Database" means a set of Participants' personal data obtained in connection with their
participation in the Program, the controller of which within the meaning of the Act is the Organizer;
1.7. "Act" means the Act of 29 August 1997 on the protection of personal data (i.e. Journal of Laws of 2016, item 922);
1.8. "Goods" mean these goods, the acquisition of which, in accordance with the Terms and Conditions,
results in a relevant discount being calculated and obtained.
1.9. "Balance" means the sum of all purchases made by the Participant, including returns of Goods.

II. GENERAL PROVISIONS:

2.1. A Participant may be a natural person aged 18 or more having full capacity to perform acts in law.
2.2. The Organizer's employees and members of the immediate families of the Organizer's employees (i.e.
descendants, ascendants, siblings, adoptees) cannot be Program Participants.
2.3. A Participant can have only one active Participant's Account at a time. Any instances of notifying the
Organizer referred to in these Terms and Conditions may be done only and exclusively by the Participant or
a person holding a power of attorney issued by the Participant.
2.4. The Participant is entitled to join the Program upon making a single purchase at the Boutique. The
customer fills in the electronic form, agreeing to join the program and register their e-mail address as an
identifier in the system.
2.5. Joining the Program can also take place via the Online Store by selecting the appropriate consent at the stage of placing an order.
2.6. Joining the Program after completing the Declaration or submitting the Form takes place on the basis of the registration of the Participant by the Organizer, after verifying that the person completing the Declaration or submitting the Form meets the requirements of the Terms and Conditions and that their Declaration or Form (fields required for registration) are filled in correctly.
2.7. These Terms and Conditions will be available in Boutiques, on the Organizer's website robertkupisz.com and in system messages sent to the Participant as part of the program.

III. PERSONAL DATA:

3.1. The processing of the Participant's personal data is carried out in accordance with the Act.
3.2. The Participant voluntarily provides the Organizer with their personal data in connection with their
participation in the Program and for purposes related to the participation in the Program. This data is
contained in the Declaration, Form or other statements submitted to the Organizer. The Participant has the
right to inspect the content of their data as well as request its update or correction.
3.3. Personal data is entered into the Database.
3.4. The Participant should, if possible, immediately notify the Organizer each time there has been a change in their personal data. The Participant may submit changes by phone or by post sent to the Regular Customer Service Office.
3.5. The Participant may consent to the processing of their data to a greater extent than indicated above.

IV. GRANTING OF DISCOUNTS:

4.1. The Organizer grants the Participant a discount for the purchase of Goods or Services in Boutiques and
in the Online Store, in the amount specified in the Terms and Conditions. Value of purchases is counted from the Participant's first transaction after registering in the Program in accordance with the Terms and
Conditions, or in the case of Customers who gave their commercial consent earlier, the value of purchases is
counted from 1 November 2016.
4.2. Additionally, extra discounts may also be granted to the Participant's Account as part of promotional and
bonus programs offered by the Organizer according to the rules specified in the Organizer's information
materials concerning such programs.
4.3. The condition for registering the purchases on the Participant's Account is providing an e-mail address
or name and surname, provided by the Participant when creating the Account to an employee at the Boutique before the Participant purchases the Goods or a Service covered by the Program (before closing the transaction). The value of purchases is added to the Participant's Balance immediately after the transaction is made.
4.4. In the case of purchasing the Goods in the Online Store, in order to register the purchase, the Participant
should log in using the e-mail address provided by the Participant when creating the Account. The completed
transaction then serves as the basis for registering purchases. The value of the transaction will be added to the Participant's Balance after 15 days, taking into account the possibility of return of the purchased Goods.
4.5. Discounts will be granted to the Participant's Account in the following way:
4.5.1. Discounts will be granted after the purchase of Goods or Services in accordance with the principle:
a) in the case of purchase of Goods for a total amount exceeding PLN 10,000 gross – 5% discount for each
subsequent purchase in the Online Store or in Boutiques (GOLD STATUS)
b) in the case of purchase of Goods for a total amount exceeding PLN 20,000 gross – 10% discount for each
subsequent purchase in the Online Store or in Boutiques (BLACK STATUS)
4.6. If the discounts have been issued or granted contrary to the Terms and Conditions, the Organizer will be
entitled to cancel the relevant discount on the given Participant's Account.
4.7. Discounts cannot be exchanged for cash and cannot be combined with other promotions offered by the Organizer.
4.8 The balance of the Participant's Account will be reduced if the Participant returns the purchased Goods
to the Organizer.
4.9. The Participant is entitled to receive information about the status of their Participant's Account as well
as information on discounts granted to the Participant's Account. The Participant may obtain information on the status of their Account in the "My Account" tab after logging into the Participant's Account at robertkupisz.com or during a visit to a Boutique.
4.10. The Participant has the right to file a complaint if the value of purchases has not been added to the
Participant's Account. Complaints can be submitted to the seller at the Boutique or sent to the Customer
Service Office at the following address: bok@robertkupisz.com or postal address: Qπш [KU-PI-SH] Loyalty Program ul. Cybernetyki 19A, 02-677 Warsaw. In order to speed up the procedure, the Organizer requests a copy of the receipt confirming the purchase of the Goods or Services covered by the Program, in relation to which the Participant submits the complaint. Every such complaint is considered individually by the Organizer.

V. END OF THE PROGRAM, EXCLUSION FROM THE PROGRAM:

5.1. The Organizer may refuse to register someone in the Program if:
5.1.1. The Participant doesn't meet the requirements specified in the Terms and Conditions;
5.1.2. The Form is completed incorrectly, doesn't contain the name and surname of the Participant;
5.1.3. The Participant has not expressed commercial consent in connection with their participation in the
Program and for purposes related to participation in the Program;
5.1.4. The Declaration is incorrectly completed, the Participant's details have not been confirmed.
5.2. The Organizer may terminate the participation in the Program of a Participant, with notification, if
the Participant provided false information in the Declaration or Form.
5.3. The Organizer may terminate the participation of a Participant in the Program with notice also in the
event that the Participant isn't actively participating in the Program for more than 24 months, where this
period is understood as a situation in which the Participant has not made a purchase, which has been
registered in their Customer Account, for a period of 24 months from the date of the previous such entry.
5.4. The Participant may resign from participation in the Program at any time. After receiving a written
notification in this regard, the Participant's Account will be closed.
5.5. In the event of termination of participation in the Program, the Organizer is entitled to close the
Participant's Account and to cancel all discounts granted to the Participant's Account.
5.6. The Program remains in force indefinitely. The Program begins upon the announcement about its start.
The Organizer reserves the right to end the Program after a prior notification sent 30 days in advance.
5.7. In the event the Program ends, the Organizer is obliged to post information about ending of the Program in the Boutiques and on the Organiser's website, as well as to notify the Participants in the manner provided for in Chapter IX of the Terms and Conditions.

VI. CHANGES:

6.1. The Organizer is entitled to make changes to these Terms and Conditions with effect for the future.
6.2. In the event of changes made to these Terms and Conditions, the Organizer will each time notify the
Participants about changes to the Terms and Conditions by putting the text of the amended Terms and Conditions of the Program in the Boutiques, on the Organiser's website and using other means of
communication.
6.3. The changed Terms and Conditions will come into force after 30 days from the date of their
announcement. In the event that the Participant doesn't consent to the changes to the Terms and Condition, they have the right to resign from participation in the Program before the changes come into force. This does not exclude or limit the Participant's right to resign from participation in the Program at any time.

VII. NOTIFICATIONS:

7.1. Unless the Terms and Conditions state otherwise, a notification is deemed to be delivered to the
Participant if it is sent by post to the address indicated in the Declaration or Form, or by e-mail to the e-mail
address provided by the Participant and entered into the Database. Any complaints regarding the delivery in
the manner specified in this clause will be recognized individually based on factual circumstances.
7.2. Notifications to the Organizer may be sent in the following way: by post to the Organiser's address with
the note "Qπш [KU-PI-SH] LOYALTY PROGRAM" to the following address: Cybernetyki 19A, 02-677 Warsaw
