I Introduction
1. The administrator of the robertkupisz.com online store ("Store") is Art Works sp. z o. o. based in Łomianki, ul. Kampinoska 2, with NIP 118-16-11-037, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw, 14th Commercial Division of the National Court Register under KRS number 0000047711; e-mail: bok@robertkupisz.com, tel: +48 786 100 123 ("Administrator", "Art Works"). The Customer may contact the Administrator using the above-mentioned data.
2. The store allows you to purchase goods via the electronic network (Internet).
3. These Regulations are addressed to all users of the Store and specify the rules for registering and using the Store account, the rules for placing orders in the Store and the rules for concluding contracts for the sale of goods.
4. Each user can gain access to the Regulations at any time by "clicking" the "Regulations" link located on the Store's website.
5. Information about products in the Store, including: descriptions and prices constitute an invitation to submit an offer to conclude a contract or sell within the meaning of Art. 71 of the Civil Code, in accordance with the terms of the Regulations.
6. The goods in the Store are marked in detail. The website contains information about the properties of the product, its price, the material it is made of, color, size, etc.
7. Photos and presentations of the offered products are intended to present the specific models indicated in them.
II Rules of using the store
1. Art Works sp. z o. o. enables the conclusion of sales contracts for goods presented in the Store via the Internet and provides other services provided for in these Regulations.
2. The contract for the sale of goods is concluded between the user of the Store ("Customer") and Art Works sp. z o. o. based in Łomianki.
3. The essential provisions of contracts concluded via means of distance communication are recorded, secured and made available by printing and providing the Customer with proof of purchase (receipt or VAT invoice) together with the delivery of goods.
4. The condition for starting to use the store is to read and accept these Regulations.
5. The information provided by the Customer when placing an order should be true, current and accurate. Art Works sp. z o. o. reserves the right to refuse to process an order if the data provided is so inaccurate that it makes it impossible to complete the order, and in particular prevents proper delivery of the shipment. Before refusing to complete the order, Art Works sp. z o. o. will attempt to contact the Customer in order to obtain the data necessary to complete the order.
6. The Store takes all possible technical and organizational measures required by applicable law to protect Customers' personal data, in particular to prevent unauthorized persons from obtaining and modifying the data provided during registration and placing an order.
7. The Customer who used the Store is obliged to:
a. not providing or transmitting content prohibited by law;
b. use the Store in a way that does not interfere with its operation;
c. not to send or place unsolicited commercial information in the Store;
d. use the Store in a way that is not inconvenient for other Customers and the Store Administrator;
e. use the content posted on the store's website for your own use.
III. Conclusion of a sales contract
1. To conclude a sales contract, place an order on the Store's website.
2. The store accepts orders placed online 24 hours a day, every day of the week. Orders placed on non-working days will be processed on the first business day following the day on which the order was placed.
3. The customer can place an order without prior registration (so-called shopping without registration).
4. The condition for placing an order is to fill out all the required data necessary for shipping in the form.
5. In order to place an order, you must select products from the Store's available offer, their colors, sizes and quantities by "adding" them to the cart.
6. Until the Customer clicks the "Order with obligation to pay" button, the Customer may make changes and modifications to the products in the order, as well as contact details for shipment or invoice.
7. Placing an order by the Customer (confirmation by clicking the "Order with obligation to pay" button) constitutes the Customer's offer to Art Works sp. z o. o. to conclude a Sales Agreement, in accordance with the Regulations and the placed order.
8. The Store sends confirmation of acceptance of the Customer's offer submitted electronically ("Confirmation of order acceptance") to the e-mail address provided by the Customer. The confirmation also includes the information referred to in Art. 12 section 1 of the Consumer Rights Act.
9. The sales contract is concluded in Polish or English (depending on the Customer's choice), with content consistent with these Regulations.
10. If the Customer chooses a payment method other than "cash on delivery", the store reserves the right to refuse to process the order under the sales contract if:
- the Buyer's contact details are so imprecise that they prevent delivery of the goods
- the transaction has not been authorized in the electronic payment system
- payment for the order has not been made within 5 business days of placing the order.
IV Delivery and collection
1. The deadline for completing the order in the Store, included in the order summary, is the most likely time for the Customer to prepare the products for shipment. In exceptional situations, the order processing time is confirmed by the employee during contact with the Customer, subject to section. 2 below. The store makes every effort to ensure that the goods are released to the consumer immediately, but no later than within 30 days.
2. The products are delivered to the indicated address in the Republic of Poland by forwarding companies InPost Express Sp. z o. o., InPost Paczkomaty Sp. z o. o. and DHL Parcel Polska Sp. z o. o. and selected EU countries with the forwarding company DHL Parcel Polska Sp. z o. o. and to other countries by the forwarding company DHL Express (Poland) Sp. z o. o. or in the Republic of Poland to the stationary store indicated by the Customer in the ordering process ("Boutique"). Product delivery fees are provided during the ordering process and added to its value. Customs duties upon receipt of shipments sent outside the European Union are calculated in accordance with the applicable regulations of the country to which the shipment is sent and their amount does not depend on the Store.
3. The total and maximum order completion time should not exceed 14 business days. The commencement of order processing may be delayed until the amount of the sales price (and possibly shipping costs) is credited to the Store's bank account, if the Customer chooses the payment method as online prepayment (i.e. via Przelewy24).
4. Each product sent is accompanied by proof of purchase (receipt or, at the Customer's request, after selecting the appropriate option and providing data in the ordering process - VAT invoice).
V Prices and payment methods
1. Information about the purchase price of the goods in the store is provided on the store's website and is binding. The above-mentioned price will not change regardless of price changes in the store that may occur after concluding the sales contract.
2. Product prices in the store are given in Polish zlotys, euros or US dollars and include VAT. The prices do not include the amount of customs duties if the order delivery address is specified outside the Republic of Poland.
3. The customer pays the price for the ordered products, according to his choice:
a. in cash to the forwarder of the courier company at the place of delivery (cash on delivery) - payment method only possible within the territory of the Republic of Poland,
b. by bank transfer, via electronic payment made in the Przelewy24 payment system before delivery. If the Customer chooses the payment method in the form of prepayment, failure to receive payment to the account of Art Works or entities intermediating in the transaction (Przelewy24 website) within 5 business days of placing the order will result in the cancellation of the order. In such a situation, you can place orders again and choose a different form of payment. The execution of an order paid by transfer or credit card begins after receiving payment for the goods.
4. If the Customer chooses the option of delivery of goods outside the territory of the Republic of Poland, in accordance with the principles of these Regulations, payment of the price of the goods is possible only in the form of electronic payment.
5. Art Works reserves the right to change the prices of goods in the Store, introduce new goods for sale, carry out promotional campaigns on the Store's websites, or introduce changes therein in accordance with the standards of the Civil Code and other acts, and such changes do not violate the rights of persons who concluded sales contracts for goods offered by the Store before making the above-mentioned changes or rights of persons authorized to use a given promotion, in accordance with its rules and during its duration.
VI Warranty and complaints
1. The products offered in the store are brand new and original. Art Works is obliged to deliver items to the Customer without defects.
2. Art Works is liable for defects in items (warranty). This liability is regulated in the provisions of the Civil Code ("CC"), in particular in Art. 556, 556[1]-556[3] Civil Code and Art. 559-561 CC
3. Art Works takes steps to ensure the full proper functioning of the Store, to the extent that results from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
4. Each item purchased in the store may be subject to a complaint in compliance with the deadlines and complaint conditions specified in the relevant provisions of law, if it has physical or legal defects.
Complaints may be submitted by post by returning the goods together with a written description of the defect or a complaint form downloaded from the Store's website, by registered mail or another form of delivery, to the following address: Online store robertkupisz.com, Art Works sp. z o. o., ul. Sandomierska 13, 02-567 Warszawa, with the note: "Complaint online store robertkupisz.com". The customer will receive information on how the complaint will be considered within 14 days from the date of receipt by the Store of the shipment containing the complained goods. If the data or information provided in the complaint need to be supplemented, before considering the complaint, Art Works will ask the Customer to supplement them in the indicated scope. The 14-day period will be counted from providing the information necessary to consider the complaint.
5. If the complaint is not accepted, the goods will be sent back along with an opinion on the groundlessness of the complaint.
6. If the Customer finds damage to the goods during transport, it is recommended that the Customer prepares the so-called damage report.
7. If the buyer is not a consumer, Art Works' liability under the warranty is excluded.
VI Extrajudicial settlement of disputes
1. The rules for conducting proceedings for out-of-court resolution of consumer disputes are specified in particular by the provisions of the Act of 23 September 2016 on out-of-court resolution of consumer disputes (Journal of Laws of 2016, item 1823) and the regulations of conduct of individual authorized entities.
2. The use of out-of-court methods of resolving consumer disputes is voluntary. Art Works sp. z o. o.'s declaration of consent or refusal to participate in the proceedings for out-of-court resolution of consumer disputes will be submitted on paper or another durable medium if, following a complaint submitted by the consumer, the dispute is not resolved.
3. Detailed information on the possibility of using out-of-court methods of resolving consumer disputes is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of the Trade Inspection, in particular on the website of the Office Competition and Consumer Protection at: https://www.uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php.
4. The President of the Office of Competition and Consumer Protection maintains a public register of entities authorized to conduct proceedings for out-of-court resolution of consumer disputes, available at https://uokik.gov.pl/zdrowie_podmiesz_uprawnionych.php.
5. Additionally, at http://ec.europa.eu/consumers/odr, a platform for the online system for resolving disputes between consumers and entrepreneurs at the EU level (the so-called ODR platform) is available. The ODR platform is a multilingual website with a one-stop shop for consumers and entrepreneurs seeking out-of-court resolution of disputes arising from an online sales contract.
VII Withdrawal from a distance contract
1. A consumer who has concluded a distance contract may withdraw from it within 30 days without giving any reason.
2. The deadline for withdrawal from the contract expires after 30 days from the date on which the consumer came into possession of the item or on which a third party other than the carrier and indicated by the consumer came into possession of the item.
3. To exercise the right of withdrawal, the consumer must inform Art Works (Online store robertkupisz.com, Art Works sp. z o. o., ul. Cybernetyki 19 building A, 3rd floor, 02-677 Warszawa, e-mail: bok@robertkupisz. com, tel. +48 786 100 123, about the decision to withdraw by way of an unambiguous statement (e.g. by a letter sent by post, fax or e-mail).
4. The consumer may use the model withdrawal form, but this is not obligatory.
5. In order to meet the deadline for withdrawal from the contract, it is sufficient for the consumer to send Art Works information regarding the exercise of the consumer's right to withdraw from the contract before the deadline for withdrawal from the contract expires.
6. In the event of withdrawal from the contract, Art Works will refund to the consumer all payment costs received from him, including the costs of delivering the goods (except for additional costs resulting from the delivery method chosen by the consumer other than the cheapest delivery method offered by Art Works) immediately and in any case case, no later than 14 days from the date on which Art Works was informed by the consumer about his decision to withdraw from the contract. The refund will be made using the same payment methods that were used by the consumer in the original transaction, unless the consumer has expressly agreed to a different solution. In any case, the consumer will not incur any fees in connection with this return.
7. Art Works may withhold the refund until the item is received or until the consumer provides proof of returning it, depending on which event occurs first.
8. In the event of withdrawal from the contract, the consumer should send back or deliver the item to Art Works to the address provided in section 3, immediately, and at any time no later than 30 days from the date on which the consumer informed Art Works about withdrawal from the contract. The deadline is met if the consumer returns the item before the 30-day deadline expires.
9. The consumer bears the direct costs of returning the item.
10. The consumer is only responsible for the reduction in the value of the item resulting from using it in a way other than what was necessary to establish the nature, characteristics and functioning of the item.
11. The consumer has the right to return a product from the "Buy one t-shirt with an eagle, get the second one for 50%" promotion. By returning any T-shirt with an eagle, the consumer receives a refund of the discounted product.
VIII Information regarding services provided electronically
1. The Administrator provides the following services to Customers electronically:
a. enabling the conclusion of online contracts for the sale of goods in the Store in accordance with these Regulations,
b. enabling the creation of Customer accounts in the Store,
c. sending the ordered commercial information regarding the goods
2. The customer is entitled to withdraw from contracts for the sale of goods in accordance with the relevant legal provisions and on the terms set out in these Regulations. Moreover, the Customer is entitled at any time to demand that the Store cease to provide the services indicated in point 1(b) and (c) above.
3. The technical conditions for the provision of electronic services by the Store are as follows:
a. access to the Internet,
b. using a web browser that allows editing hypertext documents (such as Internet Explorer, FireFox, Chrome, Safari),
c. having an e-mail account.
4. Complaints regarding services provided by the Administrator electronically may be submitted by sending the complaint to the e-mail address: bok@robertkupisz.com or using the contact form available in the Store. The customer's complaint should include the name of the service recipient and a short description of the complaint. The Store will make every effort to ensure that the submitted complaints are considered as soon as possible, but no later than 14 days from the date of receipt of the Complaint by the Store. The Customer will be notified about how the complaint will be handled by phone or via e-mail sent to the e-mail address provided by the Customer.
5. Depending on the settings of the Customer's web browser, Art Works sp. z o. o. may introduce cookies into the IT system used by the Customer, which are not a component of the content of the services provided by the Store, and which enable the subsequent identification of the Customer entering the Store's website and are used by the Store to facilitate the Customer's use of the Store, as well as to monitor Customer traffic on the Store's websites. The Customer may at any time disable the Store's use of cookies through appropriate settings in his web browser.
6. The Administrator informs that he makes every effort to ensure that the use of the Store is as safe as possible for Customers. However, the Administrator informs that a particular risk related to the use of the Store, as well as any other websites, is the potential risk of unauthorized access to the Store by third parties (so-called hacking), which may cause unforeseen changes in the operation of the Store.
IX Personal data
1. Customers' personal data provided during registration in the Store are processed by Art Works sp. z o. o. solely for the purpose of fulfilling orders and using the Store, and may also be processed for marketing purposes, provided that the Customer consents to this in a separate statement. The customer has the right to supplement, update, rectify personal data, temporarily or permanently suspend consent to their processing or request their deletion. The data is provided voluntarily.
2. If you choose the delivery method using a courier shipment, your personal data will be entrusted to DHL Express (Poland) Sp. z o. o. and DHL Parcel Polska Sp. z o. o., in order to provide services by DHL Express (Poland) Sp. z o. o. and DHL Parcel Polska Sp. z o. o
X Final provisions
1. Lack of acceptance of the provisions of these Regulations prevents the purchase of goods offered by the Store. The Store will enable the Customer to read the Regulations when placing an order.
2. Polish law applies to the contract for the sale of products in the Store.
3. In matters not regulated by these regulations, the provisions of the Civil Code or other legal acts applicable to the activities and functioning of the Store shall apply accordingly.
4. The court competent to resolve disputes is the court with local jurisdiction according to: applicable regulations.
5. Only to the extent permitted by law, Art Works sp. z o. o. reserves the right to make changes to the Regulations, in particular resulting from changes in applicable legal provisions affecting the provisions of the Regulations. Changes to the Regulations are valid within 14 days from the moment they are published on the Store's website. Changes to the Regulations apply to orders placed after a given change to these Regulations has been made. Customers who have an account in the Store will be informed about changes to the regulations via e-mail. A customer who does not accept the changes introduced in the Regulations has the right to delete the account at any time.
6. All trademarks and company names posted in the Store belong to their legal owners.

1.1 Code value 10%
1.2 The promotional code is valid for 30 days and applies to a one-time purchase at robertkupisz.com and in QПШ Robert Kupisz proprietary boutiques.
1.3 The code can be used to purchase products from the current collection.
1.4 The promotional code cannot be combined with other promotions. If two promotional codes are provided in the online boutique, the system will calculate a discount that is more favorable to the customer.
1.5 The promotional code cannot be used to purchase gift cards.

§ 1
Organizer
1. The organizer of the promotion is ART WORKS Sp. z o. o. with its registered office in Łomianki (address: ul. Kampinoska 2, 05-092 Łomianki), with NIP: 118-16-11-037, REGON: 017313591, entered into the register of entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw . 2. The Promotion will be conducted in accordance with the rules set out in these Regulations (hereinafter referred to as the "Regulations"). The information contained in promotional materials is of a promotional nature only and does not constitute an offer within the meaning of the law.
§ 2
Promotion duration and conditions of participation
1. The promotion is valid from November 4, 2023 and will last until November 30, 2023 or while stocks last. The offer is addressed to people making purchases in the Organizer's stationary boutiques ("Participant"): ul. Mokotowska 48 (00-543 Warszawa), Stary Browar in Poznań (61-888 Poznań), CH Klif in Gdynia (81-525 Gdynia) and online on the brand's website (in the online store): "robertkupisz.com".
2. Each Participant who makes purchases for at least PLN 300.00 during the promotion period (the amount covered by one proof of purchase, e.g. receipt, VAT invoice, etc.) is entitled to receive a gift in the form of socks for PLN 1 ("Gift") .
3. The order amount entitling the Participant to receive a Gift does not include the costs of shipping the order to the Participant.
4. In the case of purchases in an online boutique, the Gift will automatically appear in the basket that meets the promotion conditions, where the purchase will be made in accordance with separate regulations of the online store applicable to the Participant.
5. The Participant cannot receive any cash or material equivalent in exchange for the Gift - he is not entitled to any claims against the Organizer in this respect.
6. Participation in the Promotion is voluntary.
7. If you return the entire order, you must also return the received Gift - in new, unused condition, with all tags.
§ 3
Final Provisions
1. The provisions of the Regulations do not exclude or limit the rights of the Participant as a consumer under the warranty arising from the Act of April 23, 1964, Civil Code (Journal of Laws 2016.380 consolidated text) or the Act of May 30, 2014 on consumer rights (Journal of Laws .U.2014.827) or other applicable legal provisions.
2. All participants of the Promotion are subject to these Regulations, in particular accepting the Gift is tantamount to the Participant's consent to the content of the Regulations and being subject to them. Participation in the Promotion is tantamount to acceptance of the rules of these Regulations.
3. The Organizer reserves the right to terminate, extend or shorten the Promotion at any time during its duration, without giving reasons, which will be done by changing the Regulations announced by the means by which the Participant was informed about the previous content of the Regulations.
4. The Organizer reserves the right to change the Regulations. Any changes to the Regulations will be effective from the date of their announcement and will be announced in the manner referred to above.
5. The regulations are available on the website "robertkupisz.com".
Final Provisions
1. The provisions of the Regulations do not exclude or limit the rights of the Participant as a consumer under the warranty arising from the Act of April 23, 1964, Civil Code (Journal of Laws 2016.380 consolidated text) or the Act of May 30, 2014 on consumer rights (Journal of Laws .U.2014.827) or other applicable legal provisions.
